Citirents Client Terms & Conditions

1. Introduction and Acceptance
These Terms and Conditions (“Terms”) govern the relationship between Citirents (“we”, “our”, or “us”) and the property seeker (“Client”, “you”, or “your”). By accessing our services, submitting a search request, or making a payment, you confirm that you have read, understood, and agree to be legally bound by these Terms.
2. Definitions
- "Client" refers to any individual or entity that orders and pays for Citirents services.
- "Service" refers to the real-time sourcing and sharing of available rental property options based on Client criteria.
- "Listing" refers to any property, contact info, or imagery shared with the Client during the service.
3. Nature and Scope of Service
- Citirents provides an on-demand, live house-hunting service. We do not maintain an inventory of houses, nor do we act as property managers, landlords, or leasing agents.
- We will provide up to eight (8) of the most suitable vacant houses based on your submitted budget, location, and preferences.
- You are hiring us to find the most suitable available vacant houses based on market realities, which may not always equate to a "perfect" or "dream" house. Results depend entirely on current market availability and your budget.
4. Property Availability and Viewings
- All properties are shared as vacant at the time of the search. Citirents is not responsible if a property becomes occupied, leased, or unavailable after it has been shared with you.
- Citirents does not book, reserve, hold, or guarantee any property on behalf of the Client.
5. Fees and Payment Terms
- A non-refundable service fee is required upfront before any house-hunting search commences.
- Payment of the service fee covers the search and reporting labor only. It does not guarantee that you will secure a house, nor does it deposit toward your future rent.
6. Client Responsibilities
- Provide accurate, truthful, and complete housing requirements at the start of the search.
- Independently verify the condition of the property, neighborhood safety, utility availability (water, electricity), and landlord authenticity before making any rental payments.
- Handle all tenancy negotiations, lease signing, and financial transactions directly with the property owners, landlords, or caretakers.
7. No Guarantee and Refund Policy
Due to the dynamic nature of the real estate market, Citirents does not guarantee that our listings will secure you a house. All service fees are strictly non-refundable once the house-hunting search has been initiated.
8. Non-Circumvention and Intellectual Property
The Listings and property data we curate are the intellectual property of Citirents. Clients are strictly prohibited from:
- Reselling, publishing, or redistributing Citirents Listings to third parties.
- Using Citirents data to bypass our services or facilitate viewing for un-paying third parties.
9. Prohibited Conduct
We reserve the right to terminate service immediately without a refund if a Client:
- Provides fraudulent information or fake payment confirmations.
- Subjects Citirents staff to abusive, harassing, or threatening language/behavior (via WhatsApp, calls, or emails).
10. Limitation of Liability
Liability Exclusions:
To the maximum extent permitted by the laws of Kenya, Citirents and its agents shall not be liable for any direct, indirect, incidental, or consequential damages resulting from:
- Disputes between the Client and landlords/caretakers.
- Rental deposit fraud or financial scams committed by third-party landlords.
- The physical condition of the property or safety of the neighborhood.
- WE DO NOT BOOK or pay landlord on your behalf, all dealings do directly with the property owners
11. Privacy and Data Protection
Your personal data will be processed in accordance with the Data Protection Act of Kenya. Data is used solely for service delivery and communication and will not be sold to third parties.
12. Severability and Force Majeure
- Severability: If any provision of these Terms is found unenforceable by a court, the remaining provisions will remain in full force and effect.
- Force Majeure: Citirents is not liable for delays or failures in service caused by circumstances beyond our control (e.g., severe weather, civil unrest, government restrictions).
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising shall first be resolved amicably through good-faith negotiations before resorting to Kenyan courts.
